By accessing or purchasing Services from Mad Scientist Performance, you agree to the following Terms & Conditions.
1. ELIGIBILITY
By enrolling, you confirm you are physically capable of participating in exercise activities. Services are available to individuals 18 years of age or older, or to minors under 18 years of age with the express consent and involvement of a parent or legal guardian.
By enrolling a minor, the parent or legal guardian represents and warrants that they have full legal authority to consent on the minor’s behalf and agree to be bound by these Terms & Conditions, the Privacy Policy, Refund Policy, and Waiver of Liability.
The parent or legal guardian must be present for an additional onboarding call and must approve all methods of communication used for coaching services. All coaching communications may involve or be accessible to the parent or legal guardian.
2. SERVICES OFFERED
We provide:

1:1 remote coaching with individualized programming and video review

Subscription-based training programs

One-time digital training products
Results are not guaranteed and depend on individual effort, consistency, genetics, recovery, and adherence.
3. ASSUMPTION OF RISK
Physical training involves inherent risks including injury, illness, or death. You voluntarily assume all risks associated with participation, including those arising from remote coaching and self-directed training.
4. MEDICAL CLEARANCE
You affirm that you have consulted a qualified healthcare professional or independently determined that you are medically fit to participate.
5. PAYMENTS, SUBSCRIPTIONS & BILLING

All payments are due in advance

Subscriptions automatically renew unless canceled before the next billing date

Missed sessions, incomplete check-ins, or non-compliance do not entitle you to refunds
6. INTELLECTUAL PROPERTY
All programs, videos, documents, methodologies, and materials are the exclusive intellectual property of Mad Scientist Performance. Unauthorized sharing, reproduction, or resale is prohibited.
7. CLIENT CONDUCT & TERMINATION
We reserve the right to suspend or terminate Services without refund for abusive behavior, dishonesty, policy violations, or failure to follow safety instructions.
8. MERCHANDISE SALES
Mad Scientist Performance may offer physical merchandise including apparel and accessories (“Merchandise”). All Merchandise sales are final except as required by law.
We are not responsible for sizing issues, wear-and-tear, misuse, or damage occurring after delivery. Title and risk of loss pass to the purchaser upon shipment.
Shipping times are estimates only and not guaranteed. We are not responsible for delays caused by carriers or events outside our control.
Mad Scientist Performance shall not be liable for any allergic reactions, skin irritation, or injuries resulting from the use of Merchandise.
9. LIMITATION OF LIABILITY
To the fullest extent permitted under North Carolina law, Mad Scientist Performance shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.
10. GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of North Carolina, with venue exclusively in North Carolina courts.
